1. Privacy Policy

Motorbike informs website users about its policy regarding the processing and protection of personal data of users and customers that may be collected through browsing or contracting services through its website. In this regard, Motorbike guarantees compliance with current regulations on personal data protection, reflected in Organic Law 15/1999 of December 13, on Personal Data Protection and in Royal Decree 1720/2007, of December 21, which approves the LOPD Development Regulation, as well as the General Data Protection Regulation (GDPR - EU 2016/679). The use of this website implies acceptance of this privacy policy.

2. Data Collection, Purpose and Processing

Motorbike has the duty to inform users of its website about the collection of personal data that may be carried out, either by sending email or by filling out the forms included on the website. In this regard, Motorbike will be considered responsible for the data collected through the means described above.

In turn, Motorbike informs users that the purpose of processing the collected data includes: Attending to requests made by users, inclusion in the contact list, provision of services, management of the commercial relationship to book workshop appointments or request a replacement motorcycle.

Operations, management and technical procedures that are carried out in an automated or non-automated manner and that enable the collection, storage, modification, transfer and other actions on personal data, are considered personal data processing.

All personal data collected through the Motorbike website, and therefore considered personal data processing, will be incorporated into the files declared to the Spanish Data Protection Agency by Motorbike.

Personal data will be retained for the following periods: contact requests, 1 year; motorcycle valuations, 1 year; workshop bookings, 1 year; motorcycle alerts, until the user unsubscribes. After these periods, data will be automatically and securely deleted.

3. Communication of Information to Third Parties

Motorbike informs users that their personal data will not be transferred to third party organizations, except when such data transfer is covered by a legal obligation or when the provision of a service implies the need for a contractual relationship with a data processor. In the latter case, data will only be transferred to the third party when Motorbike has the express consent of the user.

4. User Rights

Organic Law 15/1999, of December 13, on Personal Data Protection grants interested parties the possibility of exercising a series of rights related to the processing of their personal data. As long as the user's data is being processed by Motorbike, users may exercise the rights of access, rectification, cancellation, opposition and portability in accordance with current legal regulations on personal data protection.

To exercise these rights, the user must send a written communication, providing documentation proving their identity (ID card or passport), to the following address:

This communication must reflect the following information: User's first and last name, the request, home address and supporting data.

The exercise of rights must be carried out by the user themselves. However, they may be executed by an authorized person as the legal representative of the authorized party. In such case, documentation proving this representation of the interested party must be provided.

5. Third-party services and international data transfers

Motorbike uses the following third-party services that may process personal data, only when the user has given explicit consent through the cookie banner: Meta Pixel (Facebook/Instagram), to measure advertising campaign effectiveness; TikTok Pixel, for advertising conversion tracking. These services may transfer data outside the European Economic Area. These services are only activated if the user accepts marketing cookies in our consent banner.

6. Security breach notification

In the event of a security breach affecting personal data, Motorbike will notify the Spanish Data Protection Agency within a maximum of 72 hours, in accordance with Article 33 of the GDPR. If the breach poses a high risk to the rights and freedoms of data subjects, affected users will also be notified without undue delay.
